How the Annual DOT Inspection Due Date Is Calculated

Under 49 CFR §396.17, every commercial motor vehicle must be inspected at least once every 12 months. The due date is calculated from the date of the most recent qualifying inspection — not from a fixed calendar date, registration date, or the vehicle's in-service date. How often is an annual DOT inspection required?

Under 49 CFR §396.17, every commercial motor vehicle must undergo a periodic inspection at least once every 12 months. The clock runs from the date of the last qualifying inspection, not the calendar year, so two vehicles inspected on different dates will have different due dates even if they were put into service the same week.

What counts as a qualifying annual DOT inspection?

A qualifying inspection must meet the minimum requirements of 49 CFR §396.17 and Appendix A to Subpart B of Part 396, covering brakes, steering, suspension, frame, tires, wheels, lighting, and other safety-critical systems. It can be performed by a certified inspector, a state inspection program recognized by FMCSA, or a periodic inspection program that meets the federal minimum standards. A roadside inspection that covers all required items and is properly documented can also satisfy the annual requirement.

What happens if my annual DOT inspection expires?

Operating a commercial motor vehicle past its annual inspection due date is a violation of 49 CFR §396.17 and will result in an out-of-service order if discovered at a roadside inspection. The violation is also recorded against your CSA Vehicle Maintenance BASIC score, which increases the likelihood of future roadside inspections and can contribute to a compliance review.

Where must annual DOT inspection records be kept?

Under 49 CFR §396.21, the inspection report or a copy must be retained at the location where the vehicle is maintained or based for at least 14 months from the date of inspection. A copy must also be carried in the vehicle, or a sticker/decal showing the inspection date and due date may be used in place of carrying the full report, depending on state requirements.

Can I use a roadside inspection to satisfy the annual inspection requirement?

Yes. A Level I, Level V, or other roadside inspection that covers all the components listed in Appendix A to Subpart B of Part 396 and results in a passing report can be used to satisfy the periodic inspection requirement, provided it is properly documented and dated. Many carriers track these dates manually, which is a common source of missed due dates.

Does the annual inspection due date reset to a fixed calendar date?

No. The due date is always 12 months from the date of the most recent qualifying inspection, not a fixed date like January 1. If a vehicle is inspected early, the next due date moves earlier as well, since it is calculated from the new inspection date rather than the original schedule.
